An SMSF Commercial Lease Agreement sets out the rights and obligations of the owner of a commercial property, being the SMSF, and the party that has agreed to occupy the property, known as the tenant or lessee. It covers important matters including the length of the lease, termination rights, defect management, outgoings, fit-out works, limits on use of the premises, subletting, and other rights and responsibilities of the landlord and tenant. The Commercial Lease Agreement must also comply with superannuation rules.
As part of this fixed-fee package, we’ll prepare a Commercial Lease (SMSF) for your business and advise you on your legal rights and obligations. Through phone consultations with you, our expert lawyers will prepare a Commercial Lease Agreement tailored to SMSFs, as well as a disclosure document.
You’ll also receive one complimentary amendment to the final lease draft we prepare for you.
Please note that this package does not include assistance with stamp duty, if applicable, registration of the lease, tax, accounting or financial advice, or any direct negotiations or correspondence with the tenant or their lawyers. You are ultimately responsible for ensuring that the lease complies with any rules relevant to your SMSF and is capable of passing an audit. This scope also assumes that the transaction does not involve any employment, tax, accounting or other compliance issues.
